PRIVACY POLICY

This Privacy Policy of the website and the mobile application “AcadWare”, operated by TalentServ Sports Private Limited shall be read in conjunction and together with the Terms of Use available on Terms of Use. This Privacy Policy describes the information that we collect from you as part of the normal operation of the Digital Platform, and the way we operate and disclose this information. Any capitalized terms used and not defined herein shall have the meaning ascribed under the Terms of Use.

By visiting and using the Digital Platform, you agree to be bound by the Privacy Policy in registration and expressly consent to our collection, use and disclosure of your personal information.

By using the Services, you acknowledge and agree that we are providing a platform for you to access, view, share and/or post the Content on the Digital Platform. This means that other Users may search for, see, use, or share any of the Content that you make publicly available through the Services, consistent with the terms and conditions of this Privacy Policy and our Terms of Use, which can be found on the Digital Platform. Therefore, we advise you to be selective about the information that you share.

  1. Information Collected by TalentServ
    1. For becoming an Administrator or a User, you need to provide certain information, including:
      1. Your username (e-mail address) and password when you register for an Administrator Account or a User Account;
      2. Profile information that you provide for your profile (e.g., first and last name, e-mail address, date of birth, picture, phone number, gender etc.) This information allows us to help you or other users be identified on the Digital Platform;
      3. Payment processing details;
      4. Content that you post to the Services; and
      5. Communications between you and TalentServ.

      In general, you can browse the Website without revealing your identity or any personal information about yourself.

    2. As indicated on the relevant forms on the Digital Platform (which vary, as per the kind of User you are), and you are no longer anonymous to us. Wherever possible, on these forms we indicate which fields are required and which fields are optional. As you use the Digital Platform, you can also, from time to time enter personal information about third parties. For example, if you are an Administrator, you can enter personal information about your staff, trainers, trainees etc.
    3. You always have the option to not provide information by choosing not to become a User or by not using the particular feature of the Digital Platform, particularly for which the information is collected. If you are an Administrator, we also collect your billing information. We also automatically track certain information about you based upon your behavior on the Digital Platform and store it through log files. This information may include the URL that you just came from, which URL you next go, your computer browser information, and your IP address. We may provide your IP addresses to payment intermediaries in the course of the payment process.
    4. We may partner with a third party or parties to either display advertising on the Digital Platform or to manage our advertising on other sites.
  2. How We Use Your Information
    1. We collect, store and maintain the data regarding your personal information and other information we obtain from your current and past activities on the Digital Platform, to provide to you the Services offered on the Digital Platform; troubleshoot problems; measure consumer interest in our services, inform you about any offers, products, services, events and updates; deliver relevant information to you in order to customize your experience; detect and protect us against error, fraud and other criminal activity; enforce our Terms of Use; provide you with system or administrative messages. On occasions, we may use the contact information provided by you to contact you and ask for your feedback or input on our Services. If you wish to subscribe to our newsletters, we will use your name and email address to send the newsletter to you.
    2. You need to provide your personal information during the course of using some Services, for instance, provide information in your account while registering on the Digital Platform, sharing/ uploading any Content, participating in any online survey or contest, communicating with our customer service by SMS, email or otherwise, providing Feedback on the Digital Platform etc.
    3. We do not and never will modify or copy any contents from your Device. We also do not, and never will collect keystrokes, form input, user data entered into applications, screenshots, or anything that is not visible to you in your native user application. We will never look into your individual data unless you are having technical difficulties, it is required by law, or unless it is necessary to maintain our system.
    4. Out of respect for your privacy, we provide you a way to unsubscribe our email or SMS notifications by updating the settings in your account, following the instructions located in the email, or by contacting us.
  3. Our Disclosure of Your Information
    1. We will share your personal information with third parties only in ways that are described in this Privacy Policy. We do not and never will sell your personal information to third parties. We may however sell, rent, or share information about user behavior in the aggregate only. For example, we could share information like, average number of sessions recorded, average team size, average attendance, development /progress of the trainee, achievements, injuries and medical records and so on. In the normal course of business, your information shall be open for viewing to the Administrator and the Users. We will never look at your individual data unless you are having technical difficulties, it is required by law, or it is necessary to maintain our system.
    2. The following describes some of the ways that your information may be disclosed in the normal scope of business to provide the Services.
      1. Payment Information: We use credit card and other personally identifiable information that you submit to us on the Digital Platform, and other information that we collect, as required, to process payments you make using the Digital Platform through our payment processing intermediaries. We do not store credit card or other payment method information unless you choose to enter such information for use on the Digital Platform; in all other cases our payment processors have the sole and complete responsibility for the storage of credit card and payment information. We may also share personally identifiable information with our payment processor intermediaries for risk management and fraud prevention.
      2. Interactive Forums: If you post something on the Interactive Forums which is open to viewing for all, such as posting a blog or a comment on a blog, then your identity is displayed in such postings or comments, and is therefore available to the public for viewing. If you wish to have your personal identity to be confidential, you may do so by changing the settings of your account accordingly.
        The Digital Platform may include social media features, such as the Facebook and Twitter buttons and widgets, such as the ‘share’ button or interactive mini-programs that run on the Digital Platform. These features may collect your IP address, which page you are visiting on the Website, and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on the Digital Platform. Your interactions with these features are governed by the privacy policy of the third party companies providing them.
      3. Third Party Service Providers: We may, from time to time, avail services of our Affiliates, subsidiaries and unrelated service providers for the operation of the Digital Platform, and may disclose your personal information to them only to the extent required. We take reasonable care to use the services of only the service providers that we believe are competent and reputable This Privacy Policy does not apply to our internal network or to any other external websites. You hereby agree that you are solely responsible for your interactions with these third parties to which the Digital Platform may provide access (such as by clicking on a link).
  4. Administrator’s use of Information
    1. In order to facilitate the Services, the Administrator has the discretion to give to the other Users, limited or complete access to the personal information of other Users, as the Administrator may deem fit; like the Administrator may enable access to a trainer, trainees and/or their parents or its staff members to the personal information of the trainees.
    2. By accepting our Terms of Use and this Privacy Policy, you agree that, with respect to the personal information of other Users that you collect, use and disclose on the Digital Platform, you have all necessary consents and rights to collect, use and disclose that information as described in this Privacy Policy from time to time, and you agree that the indemnity you give to us in the Terms of Use applies to any non-compliance by you with the foregoing.
  5. Protection of Billing and Personal Information
    We strive to protect your personal information. Once we receive your Content, we make all commercially reasonable efforts to ensure its security on our system. Unfortunately, no data transmission over the internet can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, we cannot warrant the security of any information you transmit to us; therefore, data may, despite our efforts, be accessed and used by people other than those for whom the data is intended.
  6. Cookies
    Cookies are technologies used in analyzing trends, administering the Digital Platform, tracking your movements around the Digital Platform and to gather demographic information about your user base as a whole. We may receive reports based on the use of these technologies by these companies on an individual as well as aggregated basis. We use cookies to remember your settings, store login addresses, authenticate users, run website experiments, and store analytics data. You can control the use of cookies at the individual browser level. If you reject cookies, you may still use the Digital Platform, but your ability to use some features or areas of the Digital Platform may be limited.   7. Confidentiality and Security
    1. Your information is maintained by us in electronic form on its equipment. Such information may also be converted to physical form from time to time. We take all necessary precautions to protect your personal information both online and off-line, and implement reasonable security practices and measures including certain managerial, technical, operational and physical security control measures that are commensurate with respect to the information being collected.
    2. It is important for us that you to keep your password secured against unauthorized access to the information in your Device. Be sure to log off from the Digital Platform when finished. We do not undertake any liability for any un-authorized use of your account and password, if any. If you suspect any unauthorized use of your account, you must immediately notify us by sending an email. You will be liable to indemnify TalentServ in the event of any loss suffered by TalentServ due to such unauthorized use of your account and password.
    3. We make all shared information on the Digital Platform, accessible to our employees, agents or partners and third parties only on a need-to-know basis, and ensure that all such employees, agents or partners are bound by strict confidentiality obligations.
    4. Notwithstanding the above, we will not be responsible for the confidentiality, security or distribution of your information by any third parties outside the scope of TalentServ’s agreement with such third parties. Further, we will not be responsible for any breach of security or for any actions by any third parties or events that are beyond TalentServ’s reasonable control including, acts of government, computer hacking, unauthorized access to computer/mobile data and storage device, Device crashes, breach of security and encryption, poor quality of internet service or mobile network of the users etc.
  8. Correcting and Updating Your Personal Information
    To review, delete and update your personal information to ensure it is accurate, you may login your Account or User Account to make the changes, or you may contact us at info@acadware.com
  9. Data Retention
    We will retain your information for as long as your account is active or as needed to provide you with the Services. We will retain and use your information as may be deemed required by us to comply with our legal obligations, resolve disputes, and enforce our agreements.
  10. Notification of Privacy Statement Changes
    We may update this privacy statement to reflect changes to our information practices we will notify you by means of a notice on the Digital Platform prior to the change becoming effective. We encourage you to periodically review this page for the latest information on our privacy practices.
